Hisabi — Kenya-compliant terms

The rules for using Hisabi responsibly and securely.

1. Introduction
  • Hisabi (“the Service”, “we”, “our”, “us”) is a cloud accounting and business management platform operated by Hisabi Ltd.
  • By creating an account or using the Service, you agree to these Terms & Conditions. If you do not agree, please do not use Hisabi.
2. Eligibility
  • You are at least 18 years old.
  • You have authority to bind your business or employer.
  • You provide accurate information during registration.
3. User Responsibilities
  • Keep login details secure and control access to your account.
  • Comply with Kenyan law, including KRA, VAT, WHT, PAYE requirements.
  • Ensure data entered into Hisabi is accurate and lawful.
  • Do not misuse or disrupt the platform; use Hisabi only for lawful business purposes.
  • You are responsible for actions of anyone who uses your account.
4. Our Responsibilities
  • Provide access with reasonable uptime and notify you of material changes.
  • Protect your data in line with the Kenya Data Protection Act, 2019, including encryption and proper handling of personal data.
  • We do not provide legal, tax, or financial advice. You must review submissions before sending to KRA or any third party.
5. Subscription, Billing & Payments
  • Pricing is stated on the Hisabi website; some features require a paid plan.
  • Fees are charged monthly or annually per your selection; payments are non-refundable unless required by Kenyan consumer law.
  • We may suspend accounts for non-payment. If pricing changes, we will give reasonable notice.
6. M-Pesa & Third-Party Integrations
  • By connecting M-Pesa or other third-party services you authorise Hisabi to receive and process transaction data.
  • Safaricom’s terms and compliance rules still apply. Hisabi does not have access to your money; we only process callback data for reconciliation and invoice automation.
7. Data Ownership
  • You own all data you upload.
  • You grant Hisabi a limited licence to process your data only to provide the Service.
  • We do not sell your data. You may export your data at any time.
8. Data Protection & Privacy
  • Hisabi complies with the Kenya Data Protection Act, 2019.
  • We collect only necessary data, secure it with encryption and access controls, process it for legitimate business purposes, and do not share without consent unless required by law.

9. Account Suspension & Termination
  • We may suspend or terminate an account for breach of these Terms, non-payment, illegal activity, or compliance/security concerns.
  • You may cancel at any time. Data may be retained for legally required periods (e.g., tax compliance, audit trails).
10. Service Availability
  • We aim for high uptime but do not guarantee uninterrupted service; maintenance and outages may occur.
  • We are not liable for loss of profits, tax penalties arising from incorrect user data, or indirect/consequential damages (standard SaaS position).
11. Changes to the Service or Terms
  • We may update features, pricing, or these Terms. For material changes, we will notify you by email or in-app.
  • Continued use of Hisabi means you accept updated Terms.
12. Governing Law
  • These Terms are governed by the laws of Kenya. Disputes will be handled in Kenyan courts.
